The Finest Accessories, Inc., a Washington corporation (“TFAI,” “we,” “us,” or “our”), operates franceluxe.com and any related website, mobile experience, or online service that links to this Privacy Policy (collectively, the “Site”). This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information when you visit the Site, purchase or review our products, create an account, contact us, subscribe to communications, interact with our advertisements or social-media pages, or otherwise engage with us.

Products and communications covered by this Privacy Policy may relate to France Luxe, L. Erickson, France Luxe Body, Maison France Luxe, and other TFAI brands.

1. Personal information we collect

The personal information we collect depends on how you interact with us. We may collect identifiers and contact information, such as your name, email address, telephone number, billing and shipping addresses, account identifier, IP address, and other online identifiers. We may also collect customer and account information, including login details, account preferences, saved addresses, wish lists, customer status, and communication preferences.

When you browse the Site or make a purchase, we may collect commercial and transaction information, such as products viewed, cart activity, purchases, returns, exchanges, discounts, gift cards, order history, shipment status, and interactions with promotions. We may also receive payment-related information, including your payment method, billing details, transaction status, card type, or the last four digits of a payment card. Full payment-card credentials are generally handled by our payment processors and wallet providers rather than TFAI.

We may automatically collect Internet, device, and usage information, including your browser and device type, operating system, IP address, cookie and pixel identifiers, referring pages, pages or products viewed, search activity, clicks, session activity, and approximate location derived from your IP address. This information may be collected through cookies, pixels, software development kits, tags, server logs, analytics tools, and advertising technologies.

When you communicate or interact with us, we may collect emails, chat messages, telephone communications, contact-form submissions, survey responses, and customer-support history. If you submit a product review or other content, we may collect your rating, written review, photographs, videos, social-media handle, and other information you choose to provide.

We may collect marketing and preference information, such as your email or SMS subscription status, engagement with our campaigns, product and brand interests, audience membership, and advertising preferences. We and our commerce, analytics, affiliate, social-media, and advertising partners may use activity and purchase information to create inferences about likely interests, product or brand preferences, customer segments, or marketing audiences.

We may also collect device, transaction, account, authentication, and risk signals used to detect and prevent fraud, security incidents, and misuse. In addition, we collect other information you voluntarily provide through contests, events, surveys, job applications, or other interactions with us. We may receive information directly from you, from your device or browser, or from marketplaces, social-commerce platforms, referral partners, payment providers, fulfillment and shipping partners, and other service providers.

We may also create aggregated or deidentified information that cannot reasonably be used to identify you. We maintain and use deidentified information in deidentified form and do not attempt to reidentify it except as permitted by law.

Please do not include unnecessary sensitive information, such as medical diagnoses, precise health information, government identification numbers, or full payment-card numbers, in reviews, emails, chats, or other free-text fields.

2. How we collect personal information

We collect personal information:

• Directly from you, including when you place an order, create an account, contact us, submit a review, enter a promotion, apply for a job, or subscribe to email or SMS;
• Automatically from your device, using cookies, pixels, tags, local storage, server logs, and similar technologies;
• From commerce and payment partners, such as Shopify, payment processors, digital wallets, fraud-prevention providers, and financing providers you select;
• From marketplaces and social platforms, when you purchase through or interact with TikTok Shop or another marketplace, social-commerce service, or social-media page;
• From advertising, analytics, affiliate, and referral partners, including information about ad engagement, referrals, and campaign performance; and
• From shipping, fulfillment, customer-service, and other vendors that help us provide products and services.

3. How we use personal information

We may use personal information to:

• process, fulfill, deliver, and manage purchases, returns, exchanges, refunds, and warranties;
• create and manage customer accounts;
• communicate about orders, accounts, products, service requests, and policy or security updates;
• provide customer service and respond to inquiries;
• operate, maintain, secure, troubleshoot, personalize, and improve the Site and our business;
• detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;
• analyze Site use, product performance, customer preferences, and campaign effectiveness;
• send marketing communications when permitted and manage communication preferences;

4. Cookies, analytics, and advertising

We and our partners use cookies, pixels, tags, server-side integrations, and similar technologies to operate the Site, remember preferences, understand Site use, prevent fraud, measure campaigns, and provide or measure advertising.

These technologies generally fall into the following categories:

• Necessary: required for checkout, account access, security, fraud prevention, and core Site functions;
• Functional: remember choices and enable enhanced features;
• Analytics: help us understand traffic, performance, and how visitors use the Site; and
• Advertising: help personalize and measure ads, build audiences, and understand activity across websites or services.

Where required, non-essential technologies are used only after consent. You can manage available choices through Cookie Preferences. Your browser may also allow you to block or delete cookies, but doing so may affect Site functionality.

We may use services provided by Shopify, Google, Meta, TikTok, Pinterest, Klaviyo, and other analytics, communications, social-media, and advertising partners. These partners may collect or receive identifiers, device and usage information, commercial information, and inferences to provide measurement, audience matching, personalization, or advertising services, subject to applicable law and their own policies.

Some browsers or extensions send Global Privacy Control (GPC) or other legally recognized opt-out preference signals. Because these signals are browser- and device-specific, you may need to apply them on each browser or device you use.

5. How we disclose personal information

We may disclose personal information to:

• Commerce and hosting providers, including Shopify, which powers the online store;
• Payment and fraud-prevention providers, which process payments, verify transactions, and manage risk;
• Fulfillment, warehouse, shipping, and logistics providers, which process and deliver orders and returns;
• Customer-service, communications, and review providers, which support email, SMS, customer inquiries, account messages, and product reviews;
• Analytics, advertising, social-media, affiliate, and marketing partners, which help measure activity, personalize or deliver advertising, match audiences, attribute sales, and manage campaigns;
• Professional advisers and business vendors, including legal, accounting, insurance, IT, security, hosting, and data-management providers;
• Government authorities or other parties for legal and safety reasons, when reasonably necessary to comply with law, respond to valid legal process, protect rights and safety, prevent fraud, or enforce agreements; and
• Parties to a business transaction, such as a merger, financing, acquisition, restructuring, bankruptcy, or asset sale.

Service providers may process personal information for us under contractual restrictions. Some advertising and social-media partners may process information for their own purposes under their own privacy policies.

6. Sale, sharing, and targeted advertising

We do not sell personal information for money. However, some privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include allowing advertising or social-media partners to receive identifiers, Internet or device activity, commercial information, or inferences through cookies, pixels, audience matching, or similar tools.

During the preceding 12 months, we may have disclosed the following categories for cross-context behavioral advertising or targeted advertising: identifiers, Internet or electronic-network activity, commercial information, approximate location, and inferences. The recipients may include advertising networks, analytics providers, and social-media platforms. We do not knowingly sell or share personal information of consumers under 16.

We do not use or disclose sensitive personal information for purposes that require a right to limit under California law.

7. Email and text messages

You may unsubscribe from marketing email using the link in any marketing email. You may opt out of marketing text messages by replying STOP or following the instructions in the message. Marketing consent is not a condition of purchase.

Even if you opt out of marketing, we may send non-marketing communications about orders, returns, accounts, customer-service requests, legal notices, or security. We may keep a suppression record so we can honor an opt-out.

8. Data retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide products and services, maintain transaction and warranty records, comply with tax and accounting requirements, prevent fraud, resolve disputes, enforce agreements, and meet legal obligations.

Retention periods vary based on the type and sensitivity of information, the nature of our relationship, legal requirements, operational needs, and risk. When information is no longer required, we delete, aggregate, deidentify, or securely isolate it in accordance with our retention practices. A deletion request may be subject to lawful exceptions, but we will not deny a valid return, refund, warranty, or other consumer right merely because you exercised a privacy right.

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. You are responsible for protecting your account credentials and should contact us if you suspect unauthorized account activity.

10. Your privacy choices and rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

• confirm whether we process your personal information;
• access or receive a copy of personal information;
• correct inaccurate personal information;
• delete personal information;
• obtain a portable copy of certain personal information;
• opt out of sale, sharing, targeted advertising, or certain profiling;
• withdraw consent where processing is based on consent;
• restrict or object to certain processing;
• appeal our decision on a privacy request; and
• receive equal service and pricing without unlawful discrimination for exercising a privacy right.

Please describe your request and provide the information reasonably necessary to locate your records. We may verify your identity or authority while minimizing additional data collection. If we cannot verify a request, we may be unable to fulfill it. We will use information submitted with a request only to verify and respond to it.

Where permitted, an authorized agent may submit a request on your behalf. We may require proof of authorization and may ask you to verify your identity directly. To appeal a denial, reply to our decision or email us with the subject line “Privacy Appeal.”

We will respond within the time required by applicable law. Certain information may be exempt, such as information we must retain for legal, security, fraud-prevention, transaction, or recordkeeping purposes.

11. Additional California disclosures

This section applies only to the extent TFAI is subject to the California Consumer Privacy Act (CCPA).

In the preceding 12 months, we may have collected the categories described in Section 1; used them for the purposes in Section 3; and disclosed them to the categories of recipients in Section 5. The business or commercial purposes and sources are also described in those sections.

We may have “sold” or “shared,” as those terms are defined by the CCPA, identifiers, Internet or electronic-network activity, commercial information, approximate location, and inferences to advertising networks, analytics providers, and social-media platforms for cross-context behavioral advertising. We do not sell personal information for money. Instructions for opting out are provided in Section 6.

We may collect sensitive personal information such as account login credentials and payment information used to complete transactions. We use such information for permitted purposes, including providing requested goods and services, processing payments, security, and fraud prevention.

California residents may request to know, access, correct, or delete personal information; opt out of sale or sharing; limit certain uses of sensitive personal information where applicable; and receive nondiscriminatory treatment. California residents may also request information under California’s “Shine the Light” law by contacting us once per calendar year.

12. EEA, UK, and Swiss users

For users in the European Economic Area, United Kingdom, or Switzerland, TFAI is the controller of personal information covered by this Privacy Policy.

Depending on the processing activity, we rely on the following legal bases:

• Contract: to process and fulfill an order, provide customer service, or administer an account;
• Legitimate interests: to operate and improve our business, secure the Site, prevent fraud, analyze performance, and market products, balanced against your rights;
• Consent: for certain cookies, marketing communications, or other processing where consent is required; and
• Legal obligation: to comply with tax, accounting, consumer-protection, regulatory, and legal requirements.

Personal information may be transferred to and processed in the United States and other countries that may not provide the same level of data protection as your country. Where required, we use approved safeguards, such as standard contractual clauses, or rely on another lawful transfer mechanism.

You may have rights to access, correct, erase, restrict, or object to processing; receive data portability; and withdraw consent. You may also complain to your local data-protection authority. Withdrawal of consent does not affect processing that occurred before withdrawal.

13. Consumer health information

We do not intend to collect consumer health data through the Site except information you voluntarily provide in a customer-service request, review, or other communication. Please do not provide health information unless it is necessary for us to address your request.

14. Children’s privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13. If you believe a child has provided personal information to us, contact us so we can investigate and take appropriate action. We do not knowingly sell or share personal information of consumers under 16.

15. Third-party sites and services

The Site may link to third-party websites, platforms, or services. Their privacy practices are governed by their own policies, and this Privacy Policy does not apply to information they collect independently.

16. Changes to this Privacy Policy

We may update this Privacy Policy to reflect changes in our practices, technology, or legal obligations. The “Last Updated” date identifies the latest version. If changes materially affect how we use previously collected personal information, we will provide additional notice or obtain consent when required by law.
